While you may be able to settle out of court on a product liability claim, don't count on it. It's in the defendant's best interest to fight your claim as hard as possible, not just to save money in the short run, but to try to make sure that other people don't sue them in the long run.
It's conceivable that you could be partially to blame for a product liability accident, and you can bet that the defendants will do their best to prove that this is so. Don't admit anything, and remember: even if you are found to be partially to blame, it wasn't all you're fault, and you can still get a settlement
